1. Introduction

Supply.ContinentalHVAC.com (“we,” “us,” or “our”) operates this e-commerce platform specializing in commercial and residential HVAC equipment. By accessing or purchasing from our website, you agree to these Terms of Service (“Terms”). If you disagree, you may not use our services.

2. User Eligibility

  • You must be at least 18 years old or the age of majority in your jurisdiction.

  • Commercial buyers must provide valid business credentials upon request.

3. Product Terms

HVAC-Specific Policies

  • Product Suitability: You are responsible for verifying equipment compatibility with your property’s electrical, structural, and climate conditions.

  • Professional Installation Required: Most units require a licensed HVAC technician installation. DIY installation voids warranties unless explicitly stated.

  • Refrigerant Compliance: Purchaser is responsible for adhering to local EPA/Section 608 regulations.

Purchases

  • Prices are subject to change without notice.

  • Freight Shipping: Large units require dock/forklift for delivery. Customer is responsible for unloading.

  • Winter Shipping: Units shipped below 35°F (2°C) may incur delayed dispatch to prevent freeze damage.

4. Order & Payment

  • We reserve the right to refuse/cancel orders suspected of fraudulent activity or resale.

  • Commercial Orders: PO numbers must be provided at checkout. Net-30 terms available for approved accounts.

  • Payment Methods: Credit cards, ACH (for wholesale accounts), or financing through PayPal.

5. Shipping & Liability

  • Lead Times: Vary by product (3–7 days for in-stock items; 2–4 weeks for custom orders).

  • Inspection: Report shipping damage within 48 hours via photos to info@continentalhvac.com.

  • Title Transfer: Risk of loss passes to buyer upon delivery carrier acceptance.

6. Returns & Warranties

  • Non-Returnable Items: Custom-configured units, refrigerant-charged systems, and special orders.

  • Manufacturer Warranties: Apply only when installed by licensed professionals. Registration required within 30 days of purchase.

  • Restocking Fee: 15–25% for eligible returns.

7. Prohibited Uses

You may not:

  • Use products in violation of building codes or environmental regulations.

  • Resell equipment as “new” if installed/used.

  • Reverse-engineer or modify HVAC control software.

8. Limitation of Liability

We are not liable for:

  • Improper installation, maintenance, or operation.

  • Indirect damages (e.g., property damage, lost profits).

  • Maximum Liability: Purchase price of the product.

9. Dispute Resolution

  • Governing Law: New York laws.

  • Mediation Required: Before litigation, parties must attempt mediation in the Tristate area.

10. Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance.
